North Carolina is only one of four states that has Contributory Negligence. If you have been injured by the negligence of a third party and you are found to have contributed to your damages in any way, you will be barred from recovery.

There are exceptions. One is the doctrine of the last clear chance. Where both Plaintiff and Defendant were negligent and the Defendant had time after the acts of negligence to avoid the injury or damages and did not, then the Plaintiff will not be barred from recovery. Another exception is if the Defendant was grossly negligent, then the Plaintiff is not barred from recovery, even if the Plaintiff also contributed to the injury or damages.
